Effective Courier Service (ECS) – Terms and Conditions

Declaration of Representation and Authorization

I/We, the undersigned, do hereby solemnly affirm that all particulars, statements, and documentation provided in connection with the prescribed checklist and Form KYC are accurate, complete, and authentic to the best of my/our knowledge and belief. All documents appended have been procured through lawful means from the competent issuing authorities.

I/We undertake the obligation to notify Effective Courier Service (hereinafter referred to as “ECS”) in writing of any material alterations in the particulars provided. Failing such notification, ECS shall be entitled to rely upon the details already furnished, including, but not limited to, all shipments, declarations, and documents executed or tendered by the authorized representative indicated herein.

I/We further irrevocably authorize ECS to disclose and submit the aforesaid particulars to Customs, regulatory authorities, and any other governmental body as may be requisite for the facilitation of transport, customs clearance, and lawful handling of the shipments.

In the eventuality of shipment loss, ECS’s sole and exclusive liability shall be expressly limited to USD 100 or the declared monetary value at the time of booking, whichever is lesser. ECS shall bear no responsibility for Customs duties, levies, taxes, or other surcharges imposed by the destination country authorities.

I/We acknowledge and accept full responsibility for the content of all shipments booked under my/our name with ECS and agree to indemnify and hold ECS harmless from any and all liabilities, penalties, and proceedings arising due to content non-compliance, legal scrutiny, or regulatory action.


General Service Provision Terms

Effective Courier Service (ECS) operates as a third-party logistics provider, offering courier and express cargo services through a combination of proprietary infrastructure and contractual alliances with established carriers including DHL, UPS, FedEx, Aramex, and DPD.

By utilizing ECS services, the client enters into a binding agreement and expressly consents to the terms stipulated herein.

ECS endeavors to execute shipment delivery within an estimated timeframe, subject to operational feasibility, transit conditions, and regulatory factors. ECS does not warrant or guarantee any fixed time of delivery and expressly disclaims liability for any delays.

ECS provides no form of insurance coverage for transported goods. The onus of securing adequate insurance protection for high-value or sensitive consignments rests solely with the client.

Franchise agreements entered into by ECS are non-revocable and non-refundable. Franchise holders must strictly comply with all operational, administrative, and legal obligations as stipulated in the agreement. ECS retains the unilateral right to terminate franchise agreements at its discretion.

The responsibility for proper packaging lies entirely with the sender. ECS disclaims all liability arising from shipment damage attributable to improper packaging or inadequate labeling.

Full and irrevocable payment for services shall be remitted at the time of booking. ECS accepts cash, debit cards, and credit cards as modes of payment. Service rates and ancillary surcharges remain subject to modification without prior notice.

ECS does not accept for carriage any prohibited or unlawful goods, including but not limited to firearms, explosives, narcotics, hazardous substances, liquids, currency, precious metals, or items deemed illegal under applicable laws. ECS reserves the right to seize and report such consignments without providing recourse.

Fuel surcharges and other operational levies are subject to periodic adjustments and will be applicable at the time of shipment booking.

ECS’s total liability is strictly limited to the monetary value of the delivery service rendered. ECS expressly disclaims liability for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of business, profit, or reputation.

ECS adheres to a strict privacy policy, ensuring that client information is not disclosed to third parties except when required by law or regulatory authorities.

ECS reserves the right to unilaterally terminate any service agreement, franchise agreement, or account without notice or obligation, in cases of violation of ECS terms or illegal activities.

These terms and conditions shall be construed in accordance with and governed by the laws of India, with exclusive jurisdiction granted to the competent courts therein.


Customs, Duties, and Regulatory Compliance Provisions

ECS shall not be liable for any shipment delivery delays attributable to Customs procedures, inspections, or regulatory investigations at either the origin or destination.

In instances where shipments are held by Customs for investigation, ECS shall provide all requisite documentation but bears no responsibility for delay or outcome.

Clients are solely responsible for the accurate provision of all shipping and Customs documentation necessary to comply with the laws of both the origin and destination countries.

ECS disclaims all liability for financial or material losses incurred due to Customs processing, inspections, taxation, or regulatory assessments.

In the event of Customs detention, ECS shall notify the client via available communication channels and provide procedural updates where obtainable but makes no representation regarding expedited resolution.

All Customs duties, taxes, and import fees are additional and shall be borne by the customer or recipient.

Decisions rendered by Customs authorities regarding additional charges or clearance procedures are final, subject to local jurisdiction, and beyond ECS’s control.

Clients are advised to proactively remain informed regarding Customs regulations of the destination country and consult local Customs offices prior to shipment.


Unique and Additional Provisions

ECS strictly prohibits shipments that contravene environmental laws, promote illegal activities, or involve endangered species, with immediate termination of service for violation.

For shipments declared above USD 500 in value, ECS strongly advises procuring independent cargo insurance, as ECS liability shall not exceed USD 100.

All disputes, claims, or communications pertaining to ECS services must be made in written form via info@effectivecourier.com
